Laura Ingraham hosted Jan Crawford, CBS News legal correspondent.
Crawford said that Chief Justice Roberts handed down a novel decision on the AFfordable Care Act. Originally he was with striking down the whole law, but as he began to write his opinion he wavered about getting rid of the whole law, despite his conservative colleagues lobbying for him to stay the conservative course. Crawford said he came at it as a historical case with no doctrinal background and that it had no traction in the lower courts. She said that he also tried to bring Justice Kennedy over to his decision. In fact Kennedy was the most relentless in trying to keep Roberts on the conservative side. Ingraham noted that Kennedy flipped his vote on the Casey abortion case in the 1990s.
