Carvin said there is no limiting principle in taxing if a person doesn't buy health insurance. He said there isn't a huge difference in this and in using the Commerce Clause to enforce the individual mandate. He never thought that the taxing authority would be employed to enforce the mandate. He said there is no case in which it has been used and opens the door for all sorts of other areas Congress could force the citizens to buy goods and services. He pointed to the irony that this was never presented as a tax, including by Obama.
Carvin has no feeling about this having been a minority opinion converted to a majority opinion.
