"Face The Nation" with Bob Schieffer of May 31st focused on the nomination of Judge Sonia Sotomayor and featured Senator Dianne Feinstein and Senator Jon Kyl.
Kyl said he will meet with her on Tuesday and said he will ask her about her judicial philosophy and how much her remarks about her background will impact her decisions. Feinstein said that her statement about a Latina woman being a better judge comes down to the one word, better and went on about her background and previous confirmations for lower court positions. She also said that women have been through more to get to the top. Kyl read the oath Supreme Court justices take in which they swear not to use biases in their judgments.
Feinstein said she would ask about Sotomayor's positions on abortion, executive power and the death penalty and feels the racist label has been thrown around indiscriminately. Kyl said that the New Haven firefighters' case before the Supreme Court in which she made a decision on the 2nd Circuit will have bearing on her confirmation hearings. Feinstein said that if there is no policy, courts do make policy.
